A bailiff must always take into account the non-distraintable amount. He must immediately adjust an underestimated non-distraintable amount, at the latest within fourteen days. Access to debt assistance
Access to help: don’t wait too long to ask for help. Your municipality offers debt assistance. Take advantage of it. Notify your creditor or collection agency that you are starting debt assistance. Click here for debt assistance. No one should be denied access to debt assistance because you own a house, have no income or are undergoing treatment for addiction. Municipalities may not apply these and other grounds for exclusion. Municipalities may refuse people after weighing individual circumstances. For example, because someone does not keep to previously made agreements or seriously misbehaves towards municipal employees. With grounds for exclusion, such an assessment is not made. In that case, families simply do not qualify for debt assistance because, for example, they have no income, have not finalized their divorce or are being treated at the mental health center. This is not allowed by law.

A threatening situation means forced eviction, termination of the supply of gas, electricity, district heating or water or cancellation or dissolution of health insurance.Article 4 Municipal Debt Assistance Act states:’1. If there is a threatening situation, the first interview in which the request for help is determined will take place within three working days. A threatening situation is understood to mean forced eviction, termination of the supply of gas, electricity, district heating or water, or cancellation or dissolution of health insurance.The Municipal Executive gives the applicant insight into the number of weeks between the first interview in which the request for help is determined and the achievement of the result.’By ‘the Municipal Executive’ the legislator means the municipality.
Objection: in case of a refusal, you can file an objection within 6 weeks. The municipality must then reassess your situation and make a new decision.
